Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Nudget (“Nudget”, “we”, “us” or “our”) governing your access to and use of the Nudget household budgeting and personal‑finance application and website (the “Service”). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use Nudget. If you use the Service on behalf of a household or other people, you represent that you are authorised to do so and to bind them to these Terms.

2. The Service

Nudget helps you track accounts, transactions, budgets, savings goals and recurring bills and income, and to share finances within a household. Nudget is a money‑management tool: you enter or import your own data, and Nudget does not connect to your bank or move any money. Features vary between the Free and Premium plans and may change over time.

3. Not financial, tax or investment advice

Nudget provides tools and information for your own money management. It does not provide financial, investment, tax, accounting or legal advice, and nothing in the Service should be relied on as such. Figures, projections, “safe to spend” estimates and reports are for informational purposes only and may contain errors. You are responsible for your own financial decisions and should consult a qualified professional where appropriate.

4. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for safeguarding your login credentials and for all activity under your account. We recommend enabling two‑factor authentication.
• Notify us promptly of any unauthorised use or security breach.
• You may sign in with email and password or with a supported provider such as Google. You are responsible for maintaining access to those methods.

5. Subscriptions, billing & cancellation

• Free plan: available at no cost, subject to the limits described in the Service.
• Premium plan: a paid subscription that unlocks additional features and higher limits. Prices are shown at checkout.
• Payments: billing is handled by Stripe. By subscribing, you authorise us (through Stripe) to charge your payment method on a recurring basis until you cancel.
• Renewal: subscriptions renew automatically for the same period unless cancelled before the renewal date.
• Trials: if a free trial is offered, you will be charged when it ends unless you cancel beforehand.
• Cancellation: you may cancel at any time; your Premium access continues until the end of the current billing period. Downgrading may restrict access to Premium‑only data and features.
• Refunds: except where required by law, payments are non‑refundable.
• Price & tax changes: we may change prices with reasonable notice; changes apply to the next billing period. You are responsible for applicable taxes.

6. Households & shared access

You can create a household and invite others, granting them roles that determine what they can see and do. If you own a household, you are responsible for who you invite and for shared content within it. Members can see shared accounts and transactions; accounts marked private remain visible only to their owner. Removing a member or leaving a household may affect access to shared data.

7. Your content and data

You retain ownership of the data you put into Nudget. You grant us a limited licence to host, process, back up and display that data solely to operate and improve the Service and to provide it to you and the household members you authorise. You are responsible for the accuracy and legality of the data you enter or import, and for having the right to upload any file (such as a bank CSV) you import.

8. Acceptable use

You agree not to:

• Use the Service unlawfully or to store or process data you have no right to.
• Attempt to access accounts, data or systems that are not yours, or interfere with the Service’s security or integrity.
• Reverse engineer, scrape, overload, disrupt or probe the Service, or bypass usage limits, rate limits or plan restrictions.
• Upload malware, or use the Service to send spam or unlawful, infringing or harmful content.
• Resell, sublicense or provide the Service to third parties except through the household features we offer.

We may investigate and take action, including suspension or termination, for violations.

9. Third‑party services

The Service integrates with third parties such as Stripe (payments) and Google (sign‑in), and uses providers for email, push notifications and currency data. Your use of those services is subject to their terms and privacy policies. We are not responsible for third‑party services and do not guarantee their availability.

10. Intellectual property

The Service, including its software, design, branding and content (excluding your data), is owned by Nudget or its licensors and is protected by intellectual‑property laws. We grant you a limited, non‑exclusive, non‑transferable, revocable licence to use the Service for your personal or household money management in accordance with these Terms. All rights not expressly granted are reserved.

11. Availability & “as is”

We work to keep Nudget available and reliable, but the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free or secure, or that data or calculations will be accurate. You are responsible for keeping your own copies of important data (Nudget offers exports for this purpose).

12. Limitation of liability

To the maximum extent permitted by law, Nudget and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or financial loss, arising out of or related to your use of (or inability to use) the Service. To the extent we are found liable, our total liability for any claim will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Nudget from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your misuse of the Service, your data, or your violation of these Terms or the rights of others.

14. Suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; certain provisions (such as ownership, disclaimers, limitation of liability and indemnity) survive. Sections of the Service and your data may be handled as described in our Privacy Policy.

15. Changes to the Service and Terms

We may modify the Service or these Terms from time to time. For material changes to the Terms, we will update the “Last updated” date and provide reasonable notice. Your continued use after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you should stop using the Service.

16. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which Nudget is established, without regard to conflict‑of‑ law rules. You agree to the exclusive jurisdiction of the courts located there, except where mandatory local law grants you the right to bring proceedings elsewhere. Nothing in these Terms limits any non‑waivable statutory rights you have as a consumer.

17. General

• If any provision is found unenforceable, the remaining provisions stay in effect.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
• These Terms, together with the Privacy Policy, are the entire agreement between you and Nudget regarding the Service.
